The Fair Debt Collection Practices Act (aka FDCPA) was added to Title VIII of the Consumer Credit Protection Act in 1978.  The Act’s objectives are to prohibit abusive debt collection practices, to promote fair debt collection and to allow consumers to challenge the accuracy of debt information.  The FDCPA provides a list of guidelines to which debt collectors must adhere, outlines the rights of consumers, and details penalties for violations of the Act.

When debt collectors use threats, abusive or profane language, or deceptive tactics to collect your debt, they are harassing you and their conduct is prohibited by the Fair Debt Collection Practices Act.  You have the right to stop them from calling and force them to instead talk to your attorney.  If you think you are a victim of abusive, deceptive, or unfair debt collection practices, contact our offices for protection.
