Retaliatory Eviction
A retaliatory eviction is one filed by the landlord in response to a tenant’s good-faith complaints under the lease.  Other acts by the landlord may also qualify as illegal retaliation, such as threatening eviction, rent increases, and refusal to renew the lease.  Landlord may generally not punish a tenant for exercising a right or remedy under the law.  The burden of proof in these cases is on the landlord to prove that any actions taken following a tenant’s complaint were not done in retaliation.  The best way to defend against these claims is to keep a detailed log of all events and communications between the parties.
